1. Parties and Object

FESTARENT lays down this Privacy Policy, aimed at transparently informing Users about the website hosted at the address https://www.festarent.be, (hereinafter referred to as the ‘Site’), and on the manner in which personal data is collected and processed by FESTARENT.

The term ‘User’ refers to any user, whether a natural person or legal entity, who/that visits the Site or interacts with the Site in any manner whatsoever.

In its capacity as controller, FESTARENT shall determine all the technical, legal, and organisational means and the purposes for processing the Users’ personal data. FESTARENT undertakes to take all necessary measures to ensure that the personal data is processed in accordance with the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as the ‘Act’) and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (i.e. the General Data Protection Regulation (GDPR), hereinafter referred to as the ‘Regulation’).

FESTARENT is free to choose a natural person or legal entity that processes the users’ personal data at its request and on its behalf (hereinafter referred to as the ‘Processor’ or ‘Subcontractor’). Where appropriate, FESTARENT  undertakes to select a Processor that offers sufficient guarantees with regard to the technical and organisational measures for processing personal data, in accordance with the Act and the Regulation.


2. Processing of personal data

The use of the Site by Users may result in the collection of personal data. The processing of such data by FESTARENT, in its capacity as Controller, or by service providers acting in the name of and on behalf of FESTARENT, shall be carried out in accordance with the Act and the Regulation.

Personal data shall be processed by FESTARENT in accordance with the purposes set out below, through:

an automated procedure, the use of cookies, the sharing of free content, and a newsletter registration form.


3. Purpose of processing personal data

In accordance with Article 13 of the Regulation, the purposes of the processing of personal data shall be notified to the User. These purposes are as follows:

To ensure the performance of the services offered and agreed upon on the Site, and a legal obligation to maintain data.


4. Personal data that may be processed

The User consents to the fact that, during the visit to and while using the Site, FESTARENT shall collect and process the following personal data:

Information provided by Users when registering on the website: name, address, email address, and telephone number.

FESTARENT collects and processes this personal data in conformity with the conditions and principles described in this Privacy Policy.


5. Consent

By accessing and using the Site, the User declares that they have read and given their free, specific, informed, and unambiguous consent to the processing of their personal data. This agreement relates to the content of this Privacy Policy.

The User shall be deemed to have given their consent through the positive and active action of checking the Privacy Policy box in ‘hypertext link’. This consent is an essential condition for carrying out certain actions on the Site or for enabling the User to enter into a contractual relationship with FESTARENT. Any agreement between FESTARENT and a User relating to the services and goods offered on the Site shall be subject to the User’s acceptance of the Privacy Policy.

The User agrees that, in accordance with the terms and principles set forth in this Privacy Policy, the Controller shall collect and process the personal data that they provide on the Site or in connection with the services offered by FESTARENT for the purposes stated above.

The User shall have the right to withdraw this consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on prior consent.


6. Retention period of the personal data of the Users

In accordance with Article 13(2) of the Regulation, the Controller shall retain the personal data for only as long as is reasonably necessary for the purposes for which they are processed.

In all cases, this duration shall not exceed two years after the last customer contact.


7. Recipients of data and disclosure to third parties

Personal data may be transferred to staff, employees, subcontractors, processors, or suppliers of FESTARENT insofar as adequate guarantees are provided for the security of the data and insofar as they cooperate with FESTARENT in the marketing of the products or the provision of services. They shall act under the direct authority of FESTARENT and, in particular, shall be responsible for the collection, processing, or outsourcing of this data.

In all cases, the recipients of the data and those to whom the data is provided shall comply with the content of this Privacy Policy. FESTARENT shall ensure that it processes this data only for the intended purposes and in a discreet and secure manner.

In case the data are provided to third parties for direct marketing or canvassing purposes, the User shall be notified in advance so that they can give their prior and express consent to such use of personal data.


8. Data Protection Officer (DPO)

The following person is appointed Data Protection Officer (hereinafter referred to as ‘DPO’): Jeroen Meermans

The role of the DPO is to ensure the correct implementation of national and supranational provisions on the collection and processing of personal data.

9. Rights of the Users

Users may exercise their rights at any time by sending an email message to gdpr@festarent.be, or by sending a letter by post accompanied by a copy of their identity cards to the following address: Festarent, FAO Data Protection Officer, Voogdijstraat 29, 3500 Hasselt

a. Right of access

In accordance with Article 15 of the Regulation, FESTARENT guarantees the User’s right of access to their personal data. The User shall have the right to access this personal data as well as the following information:

  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed;
  • in case the recipients are located in third countries or international organisations, the appropriate or suitable safeguards;
  • if possible, the proposed storage period of personal data or, if this is not possible, the criteria on the basis of which this period will be determined;
  • the existence of automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the Regulation and, at least in such cases, relevant information about the underlying logic as well as the importance and expected consequences of such processing for the data subject.

The Controller may demand reasonable compensation based on the administrative costs for additional copies requested by the User.

If the User submits such a request electronically (e.g. via email address), the data will be provided in electronic form and for general use, unless the User requests otherwise.

The copy of the data shall be notified to the User no later than one month after receipt of the request.

b. Right to rectification

FESTARENT guarantees the User the right to rectify and delete personal data.

In accordance with Article 16 of the Regulation, incorrect, inaccurate, or irrelevant data may be rectified or deleted at any time. The User shall first make the necessary changes personally from their user account, unless these cannot be made independently, in which case the request may be addressed to FESTARENT.

In accordance with Article 19 of the Regulation, the controller shall notify any recipient to whom the personal data have been disclosed, concerning any rectification of the personal data, unless such rectification proves impossible or involves a disproportionate effort. The controller shall provide the data subject with information on these recipients if the data subject so requests.

c. Right of erasure

The User shall have the right to obtain the deletion of their personal data as soon as possible in the cases specified under Article 17 of the Regulation.

In case the Controller has made the personal data public and is required under the previous clause to erase it, the Controller shall, taking into account available technologies and implementation costs, take reasonable steps, including technical measures, to notify others processing such personal data on behalf of the Controller, that the data subject has, through the Controller made a request to erase the link with such personal data or a copy or reproduction thereof.

The two preceding clauses shall not apply insofar as such processing is required for the following purposes:

  • to exercise the right to freedom of expression and information;
  • to comply with a legal obligation to process under Union law or the law of the Member State to which the controller belongs, or to fulfil a task of general interest, or a task performed in the exercise of the official authority vested in the controller;
  • for the establishment, exercise, or defence of legal claims.

Pursuant to Article 19 of the Regulation, the controller shall notify each recipient to whom the personal data have been disclosed, concerning any erasure of personal data or any restriction on their processing, unless this proves impossible or involves a disproportionate effort. The controller shall provide the data subject with information on these recipients if the data subject so requests.

d. Right to restriction of processing

The User shall have the right to restrict the processing of their personal data in the cases specified in Article 18 of the Regulation.

In accordance with Article 19 of the Regulation, the controller shall notify any recipient to whom the personal data have been disclosed, concerning any restriction on the processing carried out, unless such disclosure proves impossible or involves a disproportionate effort. The controller shall provide the data subject with information on these recipients if the data subject so requests.

e. Right to data portability

In accordance with Article 20 of the Regulation, Users shall have the right to receive their personal data from FESTARENT in a structured, commonly used, and machine-readable format. Users shall have the right to transfer this data to another controller without FESTARENT having any right to prevent the same, in the cases provided for in the Regulation.

If the User exercises their right to data portability under the previous clause, they are entitled to have personal data transferred directly from one controller to another, insofar as this is technically possible.

The exercise of the right to data portability shall be without prejudice to the right to erasure. This right shall not apply to processing that may be required for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

The right to data portability shall not affect the rights and freedoms of third parties.

f. Right to object and Automated individual decision-making

The User shall have the right to object at any time to the processing of their personal data on account of their particular situation, including the automation of data by FESTARENT. In accordance with Article 21 of the Regulation, FESTARENT will no longer process personal data, unless there are legitimate and compelling grounds for the processing which override the interests and rights and freedoms of the User, or for the establishment, exercise, or defence of legal rights.

When processing personal data for canvassing purposes, the User shall have the right to object at any time to the processing of personal data relating to them for such canvassing purposes, including profiling insofar as it relates to such canvassing.

If the data subject objects to the processing for canvassing purposes, the personal data shall no longer be processed for that purpose.

g. Right to lodge a complaint

The User shall have the right to lodge a complaint concerning the processing of their personal data by FESTARENT with the Data Protection Authority competent for the Belgian territory. More information may be found on the website: https://www.gegevensbeschermingsautoriteit.be/.

The User may also file a prohibitory injunction before the chair of the court of first instance of their place of residence.


10. Cookies

The Site uses cookies to distinguish between Users of the Site. This makes it possible to provide users with a better browsing experience, and to improve the Site and its content. The objectives and methods of cookies are included in this Article.

a. General principles

A ‘Cookie’ is a file that is temporarily or permanently placed on the User’s device when viewing the Site, keeping in mind a subsequent visit. Cookies allow the server to recognise the User’s device.

Cookies can also be installed by third parties with whom FESTARENT cooperates.

Some of the cookies used by FESTARENT are required for the proper functioning of the Site, while others are required in order to improve the User’s experience.

The User may change or disable cookies.

By using the Website, the User expressly agrees to the management of cookies as described in this clause.

b. Types of cookies and intended purposes

FESTARENT uses different types of cookies on the Site:

  • Technical cookies: these are required for the functioning of the Site, to enable the communication of the data entered, and are intended to facilitate the User’s navigation;
  • Analytical and audience cookies: these cookies allow the recognition of the User and are used to count the number of Users of the Website over time. Since they also indicate browsing behaviour, they are an effective way to improve the User’s browsing experience by displaying suggestions and offers that may be of interest to the User. They also enable FESTARENT to identify and correct any bugs on the Site;
  • Functional cookies: these cookies facilitate the use of the Site by preserving certain input choices (e.g. user name or language);
  • Tracking cookies: FESTARENT uses tracking cookies via Google Analytics, in order to measure the interaction of users with the content of the Site and to produce anonymous statistics. c. Storage period for cookies

d. Managing cookies

If the User does not want the Website to place cookies on their hard disk, they may easily manage or delete these cookies by adjusting their browser settings. By programming the browser, the User can also receive notification as soon as a website uses cookies and thus decide whether to accept or reject them.

If the User disables certain cookies, they accept that the Site may not function optimally. Some parts of the Site may not be usable or may be only partially usable.

11. Limitation of the Controller’s liability

The website may contain links to other websites of third parties that are not linked to FESTARENT. The content of these sites and compliance with the Regulation and the Act are not the responsibility of FESTARENT.

The holder of parental authority must give their express consent for a minor under 16 years of age to disclose personal information or data through the Site. FESTARENT strongly recommends persons exercising parental authority over minors to promote responsible and safe use of the Internet. The Controller cannot be held liable for the collection and processing of personal information and data of minors under 16 years of age whose consent is not effectively covered by that of their legal parents, or for incorrect data – particularly with regard to age – entered by minors. Under no circumstances shall personal data be processed by the Controller if the user indicates that they are under 16 years of age.

FESTARENT shall not be responsible for the loss, damage, or theft of personal data, in particular as a result of the presence of viruses or following computer attacks.


12. Safety and security

The Controller shall implement technical and organisational measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on the implementation costs related to the nature, context, and purposes of the processing of personal data.

The Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.


13. Amendments to the Privacy Policy

FESTARENT reserves the right to amend this Privacy Policy in order to comply with legal obligations in this respect. The User is therefore requested to regularly consult the Privacy Policy in order to stay updated on any changes and amendments. Such changes shall be posted on the Site or sent by email to ensure objectionability.


14. Applicable law and jurisdiction

This Privacy Policy is governed exclusively by Belgian law. Any dispute shall be submitted to the courts of the judicial district in which the registered office of FESTARENT is located.
